Terms and conditions

These Terms and Conditions (“Terms”) govern access to and use of the Jobiti website and hiring platform operated by Jobiti B.V., Keizersgracht 555, 1017 DR Amsterdam, Netherlands (KvK 91245837, BTW NL862145937B01). By using Jobiti, you agree to these Terms. If you do not agree, do not use the service.

1. Definitions

  • “Platform” means the Jobiti website, applications, and related services.
  • “Employer” means a user posting jobs or seeking candidates.
  • “Candidate” means a user creating a profile or applying for roles.
  • “Content” means text, images, documents, messages, and other materials submitted to the Platform.

2. Service description

Jobiti provides tools for employers to publish jobs, review profiles, and manage applications, and for candidates to create profiles, explore roles, apply, and communicate with employers. Matching features may surface profiles based on selected role criteria. Platform information is provided for general guidance. Response times and outcomes may vary by role, location, and candidate availability. Jobiti is not an employer of candidates unless expressly agreed in a separate written contract.

3. Eligibility and accounts

You must be at least 18 years old and able to form a binding contract under applicable law. You agree to provide accurate, complete information and to keep it up to date. You are responsible for safeguarding login credentials and for all activity under your account. Notify us promptly at [email protected] if you suspect unauthorised access.

4. Employer and candidate responsibilities

  • Employers must post lawful, non-discriminatory, and accurate job information.
  • Candidates must provide truthful profile and application information.
  • Both parties are responsible for their own hiring decisions, interview processes, contracts, and compliance with employment and immigration law.
  • Jobiti does not guarantee interviews, placements, salary levels, or that any job will remain open.

5. Fees and payments

Candidate registration, search, and applications are free. Employers may be offered paid plans, promotions, or usage-based features. Prices, billing periods, and promotional terms (including any first-job offers) are shown at purchase or in a separate agreement and may vary by region. Fees are generally non-refundable except where required by law or expressly stated. You authorise us and our payment partners to charge applicable amounts for selected plans.

6. Acceptable use

You agree not to:

  • Post unlawful, discriminatory, misleading, or fraudulent jobs or profiles
  • Harass, spam, or abuse other users via messaging or applications
  • Scrape, harvest, or systematically extract data without our prior written consent
  • Interfere with platform security, availability, or integrity
  • Upload malware or content that infringes intellectual property or privacy rights
  • Misrepresent your identity, company, or authority to hire
  • Use the Platform for purposes unrelated to legitimate recruitment or job seeking

We may suspend or terminate accounts that violate these Terms or create risk for other users or Jobiti.

7. Content and licence

You retain ownership of Content you submit. You grant Jobiti a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, and display that Content as needed to operate, secure, and improve the Platform. You represent that you have the rights to submit the Content and that it does not violate law or third-party rights. We may remove Content that appears to breach these Terms.

8. Intellectual property

Jobiti branding, software, design, documentation, and site content are owned by Jobiti or its licensors and are protected by intellectual property laws. You may not copy, modify, reverse engineer, or create derivative works from the Platform except as allowed by mandatory law or our written permission.

9. Third-party services

The Platform may link to or integrate third-party services (for example payment providers). Those services are governed by their own terms and privacy policies. Jobiti is not responsible for third-party content or practices outside our reasonable control.

10. Disclaimers

The Platform is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant uninterrupted or error-free operation, or that matches will meet your expectations.

11. Limitation of liability

To the fullest extent permitted by Dutch law, Jobiti is not liable for indirect, incidental, special, consequential, or punitive damages; lost profits, revenue, data, or goodwill; or hiring outcomes, employment decisions, or disputes between employers and candidates. Our aggregate liability arising from the Platform is limited to the greater of (a) the fees you paid to Jobiti for the service in the three months before the claim, or (b) EUR 100, except where liability cannot be limited (including intent or gross negligence where applicable).

12. Indemnity

You agree to indemnify and hold harmless Jobiti and its directors, employees, and partners from claims, damages, and costs (including reasonable legal fees) arising from your Content, your use of the Platform, or your breach of these Terms or applicable law, except to the extent caused by Jobiti’s wilful misconduct.

13. Suspension and termination

You may stop using the Platform at any time. We may suspend or end access if you breach these Terms, if required by law, or if we discontinue the service. Provisions that by nature should survive (including intellectual property, disclaimers, liability limits, and governing law) will survive termination.

14. Changes to the Terms

We may update these Terms periodically. We will update the “Last updated” date and, where appropriate, provide notice on the site. Continued use after changes take effect means you accept the revised Terms, except where mandatory law requires additional consent.

15. Governing law and disputes

These Terms are governed by the laws of the Netherlands. Disputes shall be submitted to the competent courts of Amsterdam, without prejudice to mandatory consumer protection rules that may allow you to bring proceedings in your country of residence.
